DeKalb, GA — In a win for DeKalb County voters, the DeKalb County Republican Party and local election activist William Henderson have dismissed a lawsuit that sought a court order requiring the DeKalb County Board of Elections and Registration to convene hearings to consider challenges to the eligibility of more than 5,000 voters. The lawsuit, initially brought on the eve of the November 2024 general election, could have resulted in the systematic mass removal of voters based on unreliable data and would have violated federal law. The National Voter Registration Act of 1993 (NVRA) puts important guardrails around the circumstances under which voters may be removed from the rolls on the basis that they have moved. The NVRA also bars election officials from conducting systematic voter removals within 90 days of a federal election.
Hani Mirza, Director of the Power and Democracy Program at Advancement Project, shared the following statement:
“We applaud the dismissal of this lawsuit. The plaintiffs’ attempts to force DeKalb County to convene challenge hearings and purge voters from the rolls in violation of federal law have resoundingly failed. Advancement Project and our allies will continue to protect voters from such attempts to undermine our democracy in the future. Our communities must be heard at the ballot box to ensure free and safe elections.”
Advancement Project represented pro-voting organizations New Georgia Project and A. Philip Randolph Institute in the matter. The organizations moved to intervene in the case to protect the rights of DeKalb County voters whose eligibility to vote had been challenged.
